JUDGEMENT

(1.) (Oral) - Heard Mr. Jitendra Kishore Verma, learned Counsel appearing for the appellant. Mr. Nagendra Rai, learned Counsel appearing for the respondents is present.

(2.) Defendant no. 2 in the suit is the appellant in this appeal against the judgment and decree of affirmance.

(3.) The suit has been filed by the plaintiffs for declaration of title and removal of encroachment. The suit land has been described in Schedule 2 of the plaint and it has been further also elaborately shown in Schedule 3 of the plaint which is a sketch map.
