JUDGEMENT

(1.) IN this writ petition, the petitioner is aggrieved by Annexure 19, which, according to him, is the final gradation iist prepared by the Joint Director Agriculture, Adoptive Research, Bihar, Patna (respondent no. 4) showing him junior to respondents no. 7 to 9 on promoted post ignoring his claim.

(2.) IN short, the relevant facts are that the petitioner was initially appointed as Assistant in the Agriculture Department and posted at Saharsa on 30.8.1973. He was granted Junior Selection Grade on 1.5.1984 and Senior Selection Grade on 1.5.1987. However, on his representation, he was transferred from Saharsa Division to Chapra Division on 20.12.1993, vide Annexure 3. Later on 4.8.1998, he was transferred from Chapra to Patna Division on administrative grounds, vide Annexure 6.

(3.) LEARNED counsel for the State has not been able to show that the petitioner can be denied of his seniority as it stood while he was posted at Chapra Division from where he was transferred to Patna Division on administrative grounds.
