JUDGEMENT

(1.) AFFIDAVITS have been filed by the parties. The sons and daughters of late Rajendra Prasad have come to the term of compromise and it has been stated that they have filed affidavit before the Superintendent, Nalanda Medical College and Hospital. The terms of compromise is that the family pension should be paid to the respondent no, 8 who is the first wife of the deceased employee and other retiral dues should be paid equally to the sons and daughters of the late Rajendra Prasad from both the wives. The names of the legal heirs/claimants have been mentioned in the certificate issued by the Circle Officer, Patna Sadar which has been annexed alongwith the counter -affidavit filed by the State respondent no. 5. The legal heirs are -Urmila Pandey (the first wife) Neeraj @ Praveen Pandey and Dheeraj Pandey sons from first wife, Manish Kumar Pandey and Kumari Kamini Pandey, son and daughter from second wife.

(2.) CONSIDERING the fact that there is mutual agreement in between the parties regarding the distribution of the pensionary dues of the deceased employee, the respondents, Superintendent, Nalanda Medical College and Hospital, Patna is directed to issue an order to the Treasury Officer, Patna to pay the amount equally to the sons and daughters of the deceased employees on compromise basis. The order must be issued by the Superintendent, Nalanda Medical College and Hospital, Patna within two weeks from the date of production/communication of this order.

(3.) COPY of this order should be handed over to the J.C. to S.C. VI.
