JUDGEMENT

(1.) The question involved in this writ application is as to whether the Petitioners are entitled to. revised scale of pay of Rs. 785-1210/ - as graduate untrained teachers or to the scale of pay of Rs. 680-965/ - as intermediate untrained as has been directed to be paid by reason of the impugned order dated 28.11.1990 as contained in Annexure-8 to the writ application.

(2.) The Petitioner Nos. 1 to 5 admittedly are graduate untrained teachers. They were appointed as Science Teacher under Special Employment Scheme on a fixed stipend of Rs. 175/ -.

(3.) The Petitioner No. 6 being B.Sc. untrained was appointed on a monthly stipend of Rs. 150/ - On or about 28.9.1973, the Petitioner No. 6 passed his B.Sc examination in the year 1974. By reason of circular letter dated 27.5.1976 it was directed that all those persons who had been appointed prior to 31.3.1974 on a fixed stipend of Rs. 175/ - will get fixed salary of Rs. 296/ - per month with effect from 1.4.1975 and pursuant thereto the Petitioner Nos. 1 to 5 had been getting salary of Rs. 296/ - per month (Annexure-1). The Petitioner No. 6 had been granted a fixed salary of Rs. 296/ - per month with effect from 9.3.1977 against trained Intermediate post. The Fourth Pay Revision Committee, submitted its recommendations in terms whereof the following scales of pay had been fixed for the teachers having different qualification:
