JUDGEMENT

(1.) AFTER hearing the learned counsel for the parties, I dispose of the writ application with a direction to the respondent no. 2 to dispose of the petitioners ' application for grant of arms licence within a period of 30 days from the date of receipt of a copy of this order.

(2.) I must remind the Licensing Authority that in a State like Bihar where illegal arms are being sold like ground -nuts everywhere if a man comes to him for obtaining a licence then his application could not be kept pending just for nothing. If such applications are kept pending unnecessarily then this non - action on the part of the District Magistrate/Lecensing Authority is compelling the poor citizens to make a search of illegal arms dealers so that against the onslaught of Rangdars, extortionists, dacoits and robbers etc. they are in a position to defend themselves. I ask him to consider the question that in a given case if certain persons ' armed with illegal arms enter in the shop of a man and start shooting indiscriminately and at that point of time the person under attack uses the illegal arms to protect oneself then what shall be the position. The arms are not the ornaments, these are needed by public in a State like Bihar where everbody has to protect his ownself.
