JUDGEMENT

(1.) The petitioners, in this writ petition, have sought a mandamus against their college that is Netaji Subhash Institute of Technology, Bihta, District Patna and the University being Arya Bhatt Knowledge University, Patna directing them not to cancel their semester engineering results but to permit them to appear in the 04th semester examination.

(2.) Heard Shri Y V Giri, learned Senior Counsel for the petitioners. There is no counter affidavit on record.

(3.) In my view, no case is made out for interference. From the pleadings in the writ petition itself, it is clear that petitioners had taken admission in B Tech Engineering Course in Netaji Subhash Institute of Technology which is affiliated to Arya Bhatt Knowledge University. First semester examinations were held and pending results, they were promoted to second semester. The second semester examinations were held and they were promoted to third semester. Results of first and second semester were still awaited. For third semester, College deposited fee and forms but when no admit card was being issued by the University, petitioners filed a writ petition. Because of pendency of the said writ petition and during its pendency, apparently admit cards were issued to the third semester examinations. Petitioners took the said examination. Now the results of first, second and third semesters were published.
