JUDGEMENT

(1.) All the appellants have been convicted under Section 363 I.P.C. and even while the Appellant No.1 has been directed to execute a bond of Rs.2,000/- with one surety for maintaining peace and good behaviour for a period of one year the rest of the Appellants have been awarded 6 months R.I. by a judgment dated 4.10.1999 passed by the 1 st Additional Sessions Judge, Munger in Sessions Case No.807 of 1988.

(2.) The case of the Informant Kedar Nath Sinha is that while his son Bimal Kumar, aged about 11 years, was returning from School, the accused persons kidnapped him for ulterior reasons.

(3.) During trial the prosecution examined six witnesses in all. Out of whom, P.W.6 is a formal witness, who has proved formal F.I.R., whereas P.W.1, P.W.3 and P.W.4 are the eye witnesses of the occurrence. P.W.2 is the victim and P.W.5 is the Informant.
