JUDGEMENT

(1.) HEARD Mr. Indu Shekhar Prasad Sinha, Sr. Advocate appearing in support of this writ petition.

(2.) THE petitioner is the Secretary of the Fishermen Co -operative Society and he is facing a certificate proceeding for recovery of certain dues against the society. In this writ petition a prayer is made for quashing the certificate proceeding. Mr. Sinha advanced several points in support of the prayer for quashing the certificate case(s) pending against the petitioner.

(3.) THE JC to G.P. 9 appearing for the State submitted that the fact was otherwise. It was stated on behalf of the State that the petitioner gave an undertaking before the Certificate Officer for payment of the certificate amount in instalments but he went back on the assurance given by him and did not make any payment at all.
