(1.) The arguments raised on behalf of the petitioner and the State are same. In this case, the petitioner claims that he has completed more than 16 years as a Deed Writer right up to 2000. This fact is disputed by the State Counsel without making assertions regarding the period for which he had worked. The examination took place in the year 2000. The petitioner would have got the benefit of rule 68-B-2 of the Bihar Deed Writers Licenses Rules, if he has worked for 16 years.
(2.) The matter is thus remanded to the concerned Sub Registrar, Ganpatganj, Supaul who will consider whether the petitioner is covered under the exception provided under the Act. The petitioner would have the liberty to bring by way of a representation a deed written by him for the period from which he claims that he was working as a Deed Writer. The sub Registrar will examine whether he has completed ten years within the time as provided under the Act and rules and will also consider whether this petitioner has sat for the examination of the Deed Writers when it was held in the year 2000. If he has taken the examination, his case will be covered by the decision in the case of Md. Zakir Hussain and Others V/s. The State of Bihar & Others [CWJC No. 6838 of 2008], if not it will be covered with the statute which gives benefits to the Deed Writers working for ten years.
(3.) This writ application is disposed of with the aforesaid observations and directions.
