MADAN SINGH Vs. UNION OF INDIA

Decided On September 17, 2001
MADAN SINGH Appellant
V/S
UNION OF INDIA Respondents

JUDGEMENT

(1.) THE present cause has been brought as a public interest litigation. The complaint of the petitioner is that there is illegal storage and sale of High Speed Diesel Oil in open spaces beside the roads. It is explained that High Speed Diesel Oil is being stored in small containers and drums and that this needs to be checked by the authorities. Further, the contention is that the Oil Refineries which have franchise in the present case, the Indian Oil Corporation, should not be permitting the manner in which the High Court Speed Diesel Oil is being sold.

(2.) THE court has reservations whether a public interest litigation, as the present one, can be rushed straightaway to the High Court. The petitioner has not complained to any authority and waited for the result whether there has been inaction on behalf of the authorities in not meeting or answering the complaint of the petitioner.

(3.) DISMISSED .
