JUDGEMENT

(1.) THE petitioner, an Associate Professor, Department of Bio Chemistry, posted in Jawahar Lal Nehru Medical College, Bhagalpur, has preferred this writ petition for direction on the Respondents to promote him to the post of Professor, Department of Bio Chemistry. He has also challenged the advertisement issued on 18th December '98, as contained in Annexure -5, so far as it relates to appointment to the post of Professor, Department of Bio Chemistry.

(2.) ACCORDING to the petitioner, one Dr.D. N. Singh, junior to him, as Associate Professor and has been promoted to the higher post of Professor, vide Notification dated 28th June, 1997, but no such order has been issued in respect of petitioner.

(3.) IN connection with other case, it came to the notice of this Court that the State Government, vide Notification dated 21st May, 1997, created Teaching Cadre under Proviso to Article 309 of the Constitution of India.
