(1.) The present appeal is maintained by the appellant/State, laying challenge to judgment dated 10.09.2008, passed by learned Additional Sessions Judge, Fast Track Court, Una, District Una, H.P., in Criminal Appeal No. 8 of 2006, whereby the accused/respondent (hereinafter referred to as "the accused") was acquitted for the commission of the offences punishable under Sections 279, 337 and 304A of Indian Penal Code, 1860 (hereinafter referred to as "IPC").

(3.) The prosecution, in order to prove its case, examined as many as ten witnesses. Statement of the accused was recorded under Section 313 Cr.P.C., wherein he pleaded not guilty. The accused did not lead any evidence in his defence.
