JUDGEMENT

(1.) The question, which arises for consideration in this writ petition, is whether the petitioner fulfills the eligibility conditions prescribed in the bid document under Pradhan Mantri Gram Sadak Yojna (PMGSY) (Annexure P-2), as contained in Clause 4.4A(b) and whether his technical bid has been rightly rejected

(2.) It would be useful to reproduce Clause 4.4A(b) of the bidding document, which reads as follows:

The work in question pertains to up-gradation of road from L104-NH Dhanotu to Rohan Galfo road Km 0/0 to 32/400 under PMGSY (World Bank RRP-II) in District Mandi and the estimated cost of the project is Rs.1321.98 lakhs (construction) and Rs.154.84 lakhs (maintenance). The petitioner gave technical and financial bid and with a view to satisfy the condition as contained in sub clause
