(1.) For possessing four boxes of capsules of Parvon Spas Plus, three boxes of Spasmo Proxyvon T and two boxes of Simplex C Capsules, the petitioner, who is under arrest, on being arraigned as an accused in FIR Number 209/2019, dated 7.7.2019, registered under Sections 21 read with Section 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, (herein after referred as the "NDPS Act") and 18C of Drugs and Cosmetics Act, 1940, in the file of Police Station, Paonta Sahib, District Sirmour, H.P., disclosing Whether reporters of Local Papers may be allowed to see the judgment non-bailable offences, has come up before this Court under Section 439 Cr.PC, seeking regular bail.
(2.) The status report filed. I have seen the status report(s) as well as the police file to the extent it was necessary for deciding the present petition, and the same stands returned to the police official. I have heard Sh. Vivek Sharma, learned counsel for the petitioner and Mr. Nand Lal Thakur, learned Additional Advocate General for the respondent/State.

The gist of the First Information Report and the investigation is as follows: That on 7.7.2019 at about 6:00 p.m., when a police party headed by ASI Rupinder Singh alongwith HC Jufaan Mohammad, HC Pankaj No.68, HC Ram Kumar No.349, C. Sunny No.60 and C. Navraj No.568, Police Station, Paonta Sahib, District Sirmour, H.P., was on patrolling duty at Batapul, a secret information was received that in the parking area of Ashiana Hotel at Badripur, a white coloured swift car bearing No.HR20X-9689 was parked in which two persons were sitting with huge quantity of drug/contraband substance. On this, written information under Section 42(2) of the NDPS Act was prepared and sent through C. Navraj No.568 to SDPO, Paunta Sahib. Two independent witnesses were associated and vehicle No.HR20X-9689 was raided. A polythene bag was recovered and on checking, the aforesaid drug/contraband substance was recovered. Thereafter, the other procedural formalities were completed and the aforesaid F.I.R. came to be registered.
