JUDGEMENT

(1.) By way of instant petition filed under Section 482 of the Code of Criminal Procedure, a prayer has been made on behalf of the petitioners, for quashing of FIR No.58/19 dated 6.4.2019, under Sections 323, 341, 504 and 506 of IPC, registered with Police Station Dhalli, District Shimla, H.P., as well as consequent proceedings pending before the court below on the basis of compromise/amicable settlement arrived inter-se parties.

(2.) Averments contained in the petition, which is duly supported by an affidavit, reveal that FIR sought to be quashed came to be lodged at the behest of respondent No.2, who alleged that petitioners gave beatings to him, as a consequence of which he suffered injuries. After lodging of FIR referred herein above, parties have resolved to settle their dispute amicably inter-se them and as such, the petitioners on the basis of compromise i.e. Annexure P-2 have approached this Court in the instant proceedings, praying therein to quash FIR as well as consequent proceedings, if any, pending before the competent court of law.

(3.) On 15.10.2019, this Court having carefully perused compromise placed on record deemed it necessary to cause the presence of parties, especially respondent No.2 Hitesh Thakur, so that correctness and genuineness of compromise placed on record could be ascertained.
