JUDGEMENT

(1.) The petitioner is aggrieved by the allotment of fair price shop/ PDS Depot (for short the 'Depot') at Taruwala, Gram Panchayat, Badripur, Tehsil Paonta Sahib, District Sirmaur, in favour of respondent No. 4 and has filed the instant petition for the following substantive reliefs:-

The depot was earlier allotted to one Shri Sunil Kumar who in the year, 2010 submitted his resignation in order to enable him to contest election of the local bodies, and in the election so held Shri Sunil Kumar was elected as Up-Pradhan constraining officials- respondents to invite fresh applications for opening of depot.

(3.) Consequent upon public notice as many as five (5) applications were received and ultimately the depot was allotted in favour of respondent No. 4. Such allotment has been assailed primarily on the ground that respondents did not give adequate publicity to the notice inviting applications for allotment of the depot.
