JUDGEMENT

(1.) The instant appeal is directed against the judgement rendered on 30.5.2015 recorded by the learned Special Judge, Ghumarwin, District Bilaspur, Himachal Pradesh, Camp at Bilaspur, in Sessions trial No. 11/3 of 2013, whereby the appellant stands convicted and sentenced to undergo rigorous imprisonment for four years and to pay a fine of Rs.25,000/- and in default to undergo simple imprisonment for six months for commission of an offence punishable under Section 20(b) (ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

(2.) The prosecution story, in brief, is that Lakvir Singh, Inspector alongwith police party were present near Kali Mata Temple on patrolling duty on 18.4.2013 in an official vehicle. At about 1.15 p.m. the accused came from the opposite side wearing a purple coloured T-shirt and a black pant.

(3.) Charge stood put to the accused by the learned trial Court for his committing offence punishable under Section 20 of the Narcotic Drugs and Psychotropic Substances Act, 1985 to which he pleaded not guilty and claimed trial.
