DEVA KOUNWAR Vs. STATE OF HIMACHAL PRADESH

JUDGEMENT

(1.) The petitioner has sought regular bail in case FIR No.17/2016, registered at Police Station, Parwanoo, District Solan on 21.2.2016, under Section 20 of the Narcotic Drugs and Psychotropic Substances Act (for short 'ND&PS Act').

(2.) The respondent has produced the records of investigation and has also filed the status report.

(3.) It appears that on 21.2.2016, while ASI Joginder Singh and his team was proceeding towards Parwanoo in connection with their patrolling duty, then near village Purla, a person suddenly appeared holding a bag and who after seeing the police party became perplex and tried to flee from the spot. The person was chased for about 10-15 meters and was eventually captured with the bag. This person was none else than the petitioner upon whose search Ganja pouches were recovered and on weighment found to be 1726 grams.
