(1.) The petitioner has filed the present petition for seeking regular bail. It has been asserted that the petitioner was arrested for the commission of offences punishable under Ss. 20, 25 and 29 of the Narcotic Drugs and Psychotropic Substances Act (in short 'NDPS Act') registered vide FIR No.19 of 2023 dtd. 9/2/2023 at Police Station, Chowari, District Chamba, H.P. The petitioner is a young person aged about 31 years and is in private service. The petitioner is a permanent resident of Chamba and there is no likelihood of his absconding. He is ready to furnish the bail bonds as per the directions of the Court. The petitioner would abide by all the terms and conditions, which the Court may impose.
(2.) The petition is opposed by filing a status report asserting that the police party was present at Tunuhatti on 9/2/2023 at 4:30 am. The police checked a vehicle bearing registration No.HP-73-8472 based on suspicion and recovered one carry bag containing 1.510 Kgs of charas. The driver revealed his name as Jeet Singh. The person sitting beside the driver revealed his name as Dogra and the person sitting on the rear seat revealed his name as Ashraf Mohammad. They could not produce any document for possessing the charas. The police seized the vehicle and charas and arrested the occupants. The charas were sent for analysis to FSL and as per the report, it was found to be cannabis containing 30.06% w/w resin in it. The challan was prepared and presented before the Court. 11 witnesses have been examined and two witnesses have been given up. The petitioner was found in possession of the commercial quantity of charas and he would indulge in the commission of similar offences in case of release on bail; hence, it was prayed that the present petition be dismissed.
