(1.) A.S.I. Krishna Devi, I/C WACSU, Nalagarh, District Police Baddi, is present along with record. Record perused and returned. Status report taken on record in Cr. M.P. (M) No. 475 of 2014. Petitioner is the brother-in-law of complainant Smt. Deepika Bhalla, on whose asking FIR No. 20 of 2014 dated 25.1.2014, under Sections 498-A, 506 and 34 of the Indian Penal Code was registered at Police Station, Nalagarh, District Solan, H.P. Apprehending arrest in connection with the aforesaid F.I.R., petitioner has filed this petition seeking anticipatory bail. On 23.4.2014, this Court passed an interim order directing that in the event of arrest, petitioner shall be enlarged on bail, subject to his complying with the conditions imposed therein. The said interim order is in operation till date.
(2.) Learned Additional Advocate General, under instructions from the Investigating Officer, states that the petitioner has fully cooperated during investigation. The investigation is in progress. Undisputedly, during the course of investigation, dowry articles stand recovered from the petitioner. Petitioner's custodial interrogation is not required.
(3.) Having heard learned Counsel for the parties as also perused the record, I am of the considered view that petitioner has made out a case for confirmation of interim order dated 23.4.2014. Petitioner during investigation has fully cooperated and there is no likelihood of his fleeing away from the jurisdiction of the Court in the event of trial being initiated against him. There is nothing on record to highlight the past criminal conduct of the petitioner. His custodial interrogation is not required at all.
