(1.) THE following question has been referred to this Bench:

(2.) TO appreciate the controversy, it is better to refer to the pedigree table of the parties to this case and the facts as given in the order of reference dated 30th May, 1969. <FRM>JUDGEMENT_39_TLHPH0_1982.htm</FRM>

(3.) MST . Paro filed a suit for declaration that Mst. Parmeshri had been given land in lieu of maintenance and she could not make a will in favour of Mst. Ram Rakhi. This suit was dismissed on 31st Oct., 1949. Mst. Paro died on 7th May, 1950. Thereafter the present suit was filed by Ram Rakha and others.
