JUDGEMENT

(1.) THIS judgement shall dispose of Cr.MP(M) Nos. 589 and 590 of 2012 filed by Madhu and Biaso Devi, respectively, under section 439 Cr.P.C. for releasing them on bail in FIR No. 366/11 Whether the reporters of the local papers may be allowed to see the Judgment? Yes dated 12.10.2011, registered at Police Station, Nurpur, Distt. Kangra, H.P., under sections 498-A, 304-B, 302, 34 IPC.

(2.) IT has been stated that petitioners had filed bail applications, which were dismissed by the learned Addl. Sessions Judge, Fast Track Court, Kangra at Dharamshala on 26.11.2011. The petitioners filed Cr.MP(M) No. 107/10, which has been dismissed by the High Court on 14.2.2012 with liberty to petitioners to approach the learned Sessions Judge for bail in accordance with law. The liberty was also given to the petitioners to approach the High Court again in accordance with law.

(3.) IT has been stated that on 12.10.2011, statement of Sanjiv Kumar complainant was recorded, under section 154 Cr.P.C. The complainant had stated that Dimple Devi was the daughter of his aunt, but in relation she was also his sister-in-law. In October 2010, he married Dimple with Mohinder Singh. After some time of the marriage, Biaso Devi mother-in-law, Madhu sister-in-law, Vijay Kumar brother-in-law (Devar) and Mohinder Singh husband of Dimple had given beatings to Dimple in connection with dowry and they tortured her on small matters, Dimple for some days maintained silence but later on she narrated her torture to Rajpal Kaur wife of the complainant as well as complainant. She stated that she had been married at a wrong place. The complainant, his wife and other relations had visited the house of in-laws of Dimple, advised all concerned and told that any demand of money or any other article be directly communicated to them. The in-laws of Dimple did not improve. They sometimes demanded money or motorcycle. The brother of Dimple, her mother and other relations on coming to know all this also advised three-four times the in-laws of Dimple. The in- laws of Dimple had given beatings to Dimple twice or thrice.
