JUDGEMENT

(1.) THE petitioner has completed one year of diploma in Pathology. According to the petitioner, the syllabus for the first year course for diploma (Pathology) and the M.D. (Pathology) is the same. It is pointed out that there is a vacancy in M.D. (Pathology) and hence the petitioner may be permitted a lateral entry to the second year in M.D. (Pathology). Learned counsel for the Medical Council of India points out that the Regulations do not permit such mid stream transfer, as held by the Apex Court in Medical Council of India vs. Madhu Singh and others, : (2002) 7 SCC 258. Hence this writ petition is dismissed, so also the pending applications, if any.
