DEVINDER PAL SINGH Vs. STATE OF HIMACHAL PRADESH

JUDGEMENT

(1.) THIS is an application under Section 438 Cr.P.C. for releasing the petitioner on bail in FIR No. 67/2012 dated 07.08.2012, registered at Police Station,Gagret, District Una, under Sections 379, 411 IPC.

(2.) IT has been stated that police has registered a case on the allegation that 50 bags of cement of Government supply were recovered from two houses with 25 cement bags from each house. Some persons have been arrested, even the driver who delivered the cement bags was also arrested.

(3.) THE status report has been filed. It has been stated that on 07.08.2012 HC Yash Pal and HHC Vinod Kumar were present at Bhadarkali at about 7.45 p.m., a secret information was received that Sunil Kumar and Gopi Chand in their shops have kept stolen cement, which could be recovered if raided. A rukka was sent for registration of the case. On the basis of rukka the case has been registered.
