SHAKUNTLA DEVI Vs. STATE OF HIMACHAL PRADESH

JUDGEMENT

(1.) This writ petition has been filed by Shakuntla Devi, who is working on the post of Trained Graduate Teacher (Non Medical) at GMS Bag Chawasi since 15/5/2017. Her services were regularized on 28/10/2020 as TGT (Non Medical).

(2.) According to the petitioner, her school is situated at about five kilometers from the road, hence, the same falls within the definition of "hard/difficult area' as per the Transfer Policy, 2013. She has completed her normal tenure in the hard area and there is no public transport facility. She has submitted representation dtd. 29/9/2021 to respondent No. 2-Director, Elementary Education, Shimla, for transferring her on a vacant post, which is likely to fall vacant on account of the promotion of the incumbents working in the four schools, i.e. GMS Rara Manwana, U/C GSSS Khanot, Block Gopalpur-II, Distt. Mandi, GSSS Bhadarwar Block Gopalpur-I, GSSS Tikkri Sadhwani Block Gopalpur-II and GHS Hukkal Cluster Bharari, Block Dharampur-I.

Having regard to the limited nature of the submissions made and without commenting upon the merits of the case, we dispose of this writ petition, requiring the Director, Elementary Education, Himachal Pradesh, Shimla, Himachal Pradesh, to decide the representation of the petitioner within a period of 15 days from the date of production of a copy of this order.
