NARESH Vs. STATE OF HIMACHAL PRADESH

JUDGEMENT

(1.) An under-trial prisoner, facing trial for possessing 100 bottles of CEEREX COUGH SYRUP, has come up before this Court under Sec. 439 of the Code of Criminal Procedure, 1973 (CrPC), seeking interim bail, because his wife is being operated for appendicitis.

(2.) In Para 8 of the bail application, the petitioner declares having no criminal history.

(3.) Mr. Sunny Dhatwalia, learned Assistant Advocate General submits that in case this Court grants interim bail to the petitioner then the Court must specify the date on which the petitioner would surrender.
