(2.) HEARD .In view of the averments contained in the application, duly supported by an affidavit, the application is allowed. Order dated 4.12.2006 is recalled. The petition be registered to its original number. Application stands disposed of.

(3.) ACCORDING to Mr. K.R. Kashyap learned Counsel for the Petitioner, the issue is covered in his favour by the judgment of this Court rendered in LPA No. 36/2010, titled Sita Ram v. State of H.P. decided on 15.7.2010. If that be so, similar treatment shall also be extended to the Petitioner herein also, as extended to the Petitioner in the above referred decision, in case the Petitioner is also similarly situated, within a period of three months from the date of production of certified copy of this judgment alongwith copy of the writ petition by the Petitioner before the competent authority.
