JUDGEMENT

(1.) THE Petitioners herein are Part Time Water Carriers. Learned Senior Counsel submitted that after completion of the required number of years of part time service, they have to be conferred daily wage status and after ten years of daily wage service, they are entitled to regularization of their services. Reference is invited to the order, which is produced as Annexure P -1 wherein there is a reference to Government order dated 11.7.2006. Learned Senior counsel submits that the third Respondent may be directed to examine the factual and legal position and take appropriate action in accordance with law.

(2.) THERE will be a direction to the third Respondent to look into the matter on production of a copy of the judgment along with a copy of the writ petition by the Petitioner concerned before the third Respondent and pass appropriate orders in accordance with law and justice within a period of three months from the date of production of a copy of the judgment along with a copy of the writ petition. It is made clear that in case the Petitioners are granted daily wage status with retrospective date, the Petitioners shall not be entitled to actual back wages for the said period since they have not actually worked in the post. However, they shall be entitled to count the said period for the purpose of regularization.
