RAM SINGH Vs. STATE OF H.P.

JUDGEMENT

(1.) PETITIONER was arrested on 28.7.2008 in FIR No 154 of 2008, under Sections 382, 392, 395 and 397, Indian Penal Code and also under the Arms Act. Bail was denied to him by the court of Sessions; as such the present application has been moved under Section 439 of the Code of Criminal Procedure for his enlargement on bail.

(2.) THE challan has already been presented in the Court against the Petitioner and his co -accused. They have been charge sheeted for the aforesaid offences and the case is now fixed for the evidence of the prosecution on 5.4.2010 in the court of Additional Sessions Judge, Solan, camp at Nalagarh. The connecting evidence against the Petitioner is his statement under Section 27 Evidence Act and also the recovery of the mobile phone along with SIM which is alleged to have been provided by Shri Gurdev Singh who masterminded the dacoity. Apart from the present case, there are four more FIRs against the Petitioner under the Gambling Act, receiving of stolen property and also under the Arms Act registered in the State of Punjab.
