JUDGEMENT

(1.) Learned counsel for the petitioner submits that the recovery suit against the respondent-corporate debtor before DRT is already pending. After arguing for some time, learned counsel for the petitioner seeks and is permitted to withdraw the instant petition, as Rules pertaining to the Corporate Guarantor for filing application before the National Company Law Tribunal (Adjudicating Authority) have still not been notified, with liberty to file fresh petition on the same cause of action. Ordered accordingly.
