IN RE Vs. SCHWEITZER SYSTEMTEK (INDIA) PRIVATE LIMITED

JUDGEMENT

(1.) This Application is submitted on 08.09.2017 by one of the Financial Creditors claiming therein that a Loan was advanced of Rs. 3.50 crores to the Respondent Corporate Debtor i.e. Schweitzer Systemtek (India) Private Limited.

(2.) That the Applicant has stated that the Debtor Company was known and familiar to the Applicant due to the reason that the Applicant held one equity share in Debtor Company hence in the year 2014 advanced the said short term Loan on interest rate of 36% p.a.

(3.) That the Applicant came to know about the admission of an Application under section 10 filed by the Corporate Debtor vide NCLT order dated 03.07.2017 (CP No.1059 of 2017) . Thereafter immediately contacted the IRP Mr. Martin S.K. Golla and lodged its claim.
