JUDGEMENT

(1.) This petition has been filed under Section 252(3) of the Companies Act, 2013 by moving application in Form NCLT-9 as per Rule 87A of NCLT Rules, 2016 as inserted vide notification dated 05.7.2017 of the Ministry of Corporate Affairs. The petitioner company was incorporated on 01.01.1999. It has its registered office at Srinagar in the State of Jammu & Kashmir and therefore, the matter falls within the territorial jurisdiction of this Tribunal.

(2.) Necessary information in Form NCLT-1 as per the required proforma has also been filed at page 3 of the paper book. Certificate of Incorporation of the company is at Annexure-A and Annexure-B is the copy of Memorandum and Articles of Association of the company.
