JUDGEMENT

(1.) THIS petition has been filed seeking approval for determination of transmission tariff for Combined Assets of Tirunelveli -Edamon 400 kV D/C Line (initially to be operated at 220 kV) along with associated bays and equipments at Tirunelveli and Edamon (KSEB) (date of commercial operation: 1.7.2010) and 2 nos. switchable line reactors at Udumalpet Sub -station with associated bays and equipment (hereinafter referred to as "transmission assets") (date of commercial operation: 1.12.2010) for the period from 1.12.2010 to 31.3.2014 under Transmission System associated with Kudankulam in Southern Region for tariff block 2009 -14, based on the Central Electricity Regulatory Commission (Terms and Conditions of Tariff) Regulations, 2009 (hereinafter referred to as " 2009 regulations").

THE investment approval of the project was accorded by the Government of India vide Memorandum No. 12/18/2003 -PG dated 25.5.2005 of Ministry of Power at an estimated cost of Rs. 177929 lakh including Interest During Construction of Rs. 7141 lakh, at 4th quarter 2004 price level. Further, the Revised Cost Estimate for the subject project has been approved by the Board of Directors of the Petitioner vide Memorandum C/CCP/ Kudankulam dated 3.9.2010 at an estimated cost of Rs. 215907 lakh including Interest During Construction of Rs. 22342 lakh, at 1st Quarter, 2010 price level.

THE present petition covers determination of tariff based on actual expenditure incurred upto date of commercial operation and additional capital expenditure projected to be incurred from date of commercial operation to 31.3.2011 and during 2011 -12 & 2012 -13 respectively of the following the assets under "Transmission System associated with Kudankulam Atomic Power Project" in Southern Region.
