(1.) COMPLAINT of the appellant seeking compensation on account of the delay beyond the statutory period in remitting the amount of his provident fund was dismissed vide order dated 22.9.1997, passed by the District Forum mainly on the ground that the delay of 95 days as against the permissible period of 20 days was due to shifting of the office of the respondent from one place to another place and, therefore, respondent was not guilty for deficiency in service.
(2.) PRIMARY facts are more or less not in dispute. Appellant was employed as Administrative Assistant with M/s. Omkar Travel Private Limited and resigned from his post on 1.6.1992. His provident fund was being regularly deducted from his salary and deposited with the respondent who is the Trustee of the provident fund of the employees employed in the private sector and has, therefore, been nomenclatured as Central Board of Trustees.
(3.) APPELLANT applied for withdrawal of the provident fund and EPF on 22.11.1995 through his employer, in view of the marriage of his daughter, which was to take place on 25.1.1996. Withdrawal form was sent to the office of the respondent on 24.11.1995. Inspite of his personal visits to the office of the respondent, the matter was not settled and unfortunately the marriage of his daughter could not take place on the said date and was postponed to 6.2.1996 in the hope that the appellant would be paid his money deducted from salary and deposited towards his account of provident fund. Even till 5.2.1996 the amount was not paid and the appellant had to take loan of Rs. 70,000/ - on interest and the date of marriage was further postponed to 4.3.1996.
