(1.) THE Complainant was travelling on Austrian Airlines from Vienna to Delhi on 26.6.2004. He had informed the Austrian Airlines Authorities that pure vegetarian food should be served to him during the course of the flight. The complainant case is that the food served to him at lunch time, was not vegetarian and he refused to take the same. Thereafter when the snacks were subsequently served, it was again discovered by him, that they contained non -vegetarian material; which he did not eat and carried the packet with him. He had earlier filed complaint before the National Commission claiming Rs. one crore and twenty five lacs as damages which was dismissed by the National Commission with the following order passed on 6.8.2004:
(2.) THE Airlines in their reply have mentioned that the food served to the complainant, during the lunch time, was vegetarian food, and the packet of snacks served later was also purely vegetarian.
(3.) IT will thus appear from the rival contentions of parties that the question, which falls for decision is, whether the lunch packet and the snack packet served to the complainant by the OP Austrian Airlines, during flight, contained non -vegetarian substance or not?
