HASMUKH AMRITLAL MEHTA Vs. PLASTIC EXPORT PROMOTION COUNCIL

JUDGEMENT

(1.) This is an appeal filed by the original complainant whose Complaint No.728/2007 has been dismissed by the Mumbai Subarban District Consumer Forum, Bandra, Mumbai by its judgment dated 5/7/2008.

(2.) Facts to the extent material may be stated as under

(3.) According to the complainant he deals in export of plastic products in the name of M/s. Royal Agency and he is registered as a member of opposite party the Plastic Export Promotion Counsil who grants export promotion benefits as offered by Government of India. The O.P. renders export related services and disburses export promotion benefits on behalf of Government of India to its members on prescribed annual fess. Government of India gives financial assistance known as marketing development assistance. According to the complainant as per invitation given by O.P. dated 24/8/2006 he was selected for 14th Uganda International Trade Fair, Kampala during 4/10/2006 to 10/10/2006. He attended the same by sending cheque of Rs.20,000/- being rent for the stall in the trade fair. Subsequently the complainant submitted his claim for Rs.39,190/- being the 75% of his expenses on rent and air fare to O.P. for reimbursement as per scheme and submitted all the documents to O.P. But the O.P. failed to settle his claim. In fact, according to the complainant as per Government of India guidelines he is entitled to get 100% reimbursement and hence he claimed amount of Rs.52,254/-. He had approached Government of India, Ministry of Commerce who had directed O.P. to settle his claim but O.P. failed to settle his claim for more than last 14 months though his claim is bonafide and therefore alleging deficiency in service, he filed consumer complaint for recovering Rs.62,260/- and also claimed further interest at the rate of 18% per annum from 18/1/2007 till realization of the amount.
