JUDGEMENT

(1.) This is Crl. Misc. No. 32889-M of 1998 whereby Joginder Kaur (petitioner herein) has prayed for the grant of bail to her in case FIR No. 56 dated 10.6.98 under Section 304-B Indian Penal Code of Police Station Ghuman.

(2.) The prosecution case in brief is that Smt. Paramjit Kaur daughter of Harbans Singh was married to Harinder Singh about 2- 1/2 years ago. Harinder Singh serving in the army. As per Harbans Singh. Paramjit Kaur's father-in-law Santa Singh, mother-in-law Joginder Kaur and her husband's brother Avtar Singh began maltreating her and demanding fridge and scooter in dowry. She told her father and her father's family several times that they were maltreating her on the point of dowry. Harbans Singh could not fulfil their demand. About four months prior to 10.6.98. Paramjit Kaur was not allowed to see her father's family and the pitch of cruel treatment to her was inceased by them. On 10.6.98 at about 12.00 noon, Kamaljit Kaur informed Harbans Singh that Paramjit Kaur had been burnt by her father-in-law, mother-in-law after causing her injuries. Harbans Singh and his brother-in-law Ajit Singh and one Baldev Singh reached there and saw the dead body. The matter was reported to the police by Harbans Singh on the basis of which the aforesaid case was registered.

(3.) Learned counsel for the petitioner submitted that Kamaljit Kaur who is Paramjit Kaur's sister is married to Amrik Singh in the same village. He submitted that Paramjit Kaur's husband was in the army and in his absence, Amrik Singh tried to outrage the modesty of Paramjit Kaur and Santa Singh protested to Amrik Singh in the Panchayat. He further submitted that Amrik Singh caused injuries to Santa Singh. Case FIR No. 79 of 1997 was registered under Section 326 IPC in Police Station Ghuman against Amrik Singh on that score. He submitted that there was no animosity between Paramjit Kaur and the members of her-in-laws family and it was Amrik Singh who instigated Harbans Singh to implicate them in the death of Paramjit Kaur. In support of this submission, he drew my attention to letters Annexures P1 to P4 showing that all was well with Paramjit Kaur with her in-laws family.
