JUDGEMENT

(1.) THE present revision petition has been filed by Hardev Singh Sidhu (hereinafter described as "the petitioner") directed against the order of the learned Rent Controller, Chandigarh, dated 4.3.1997 and of the Learned Appellate Authority, Chandigarh, dated 11.9.1999. The learned Rent Controller had passed an order of eviction against the petitioner which was upheld by the learned Appellate Authority.

(2.) THE respondent had filed an eviction petition against the petitioner with respect to the suit premises. He has asserted that the agreed rent is Rs. 1400/- per month excluding electricity and water charges and the arrears of rent are due after November, 1993. Furthermore, the respondent's plea was that he was residing in a rented premises at Mohali. His landlord has asked him to vacate the said premises. The respondent requires the suit premises for himself and members of his family. The family of the respondent was stated to be consisting of himself, wife and a daughter. The respondent had not vacated any residential building in the urban area without any reasonable cause.

(3.) THE learned Rent Controller as well as the learned Appellate Authority returned concurrent findings of fact that the agreed rent is Rs. 1400/- per month which was due. The tender, therefore, was held to be deficient. It was further held that the respondent require the suit premises because he was living in a rented accommodation.
