(1.) FIR No. 37 dated 8.6.1996 has been registered at Police Station, Vigilance Bureau, Patiala Range, Patiala under Sections 420/465/467/468/ 471/120-B, Indian Penal Code read with Sections 13(1) and 13(2) of the Prevention of Corruption Act, 1988. The allegations in the FIR, registered on the basis of a report received from D.S.P. Vigilance Branch, Ludhiana, are as follows:

Jarnail Singh, District Commandant, Ludhiana (since retired), Company Commander and Jagjit Singh, Bill Clerk had been posted in various offices of Home Guard Ludhiana from Aug. 1991 to Feb. 1995. In Sept. 1991, 77 Home Guards were shown to have been deployed at the railway track from Ludhiana to Sangrur. Their attendance is marked in the beat books of the Station Masters. At the time of checking, no Home Guard was found to be present at the spot. The A.I.G., Home Guards removed all these guards on 15.1.1992. But on 21.2.1992, the District Commander again showed these very guards on duty without any approval, claimed the allowances for the period from 5.1.92 to 22.01.92 and in this way Rs. 16,177/- has been embezzled as pay of Home guards.

It has come to notice that in Dec. 1991, appointment of Home Guards has been shown in different Police Stations of district Sangrur and lists of the Guards have been sent, but no Guards have been deployed. The appointment of 47 Home Guards has been found to be fictitious and a sum of Rs. 76, 790.00 has been drawn as pay for these guards and embezzled.
