JUDGEMENT

(1.) The allegations in the petition is that respondent Nos. 4 and 5 persuaded the petitioner to pay a sum of Rs. 4.45 lacs, to send the petitioner to Foreign Country, for getting an employment, in the year 1995. Till September, 1998, the petitioner has not given any complaint, though respondents 4 and 5 failed to send the petitioner abroad. Petitioner approached respondents 4 and 5 for refund of money. Petitioner took some respectables of Panchayats before respondents for return of money during the years 1996, 1997 and 1998 and during the period of these years, the petitioner has not given any complaint.

(2.) In these circumstances, I do not find any ground to give any direction for registration of the case. However, it is open to the petitioner to approach the concerned Magistrate by filing a private complaint, if so advised, under Section 190 of the Code of Criminal Procedure, as observed by the Apex Court in All India Institute of Medical Sciences Employees Union (Regd.) v. Union of India and others, 1997 SCC(Cri) 303.
