(1.) Heard. Petitioner is the wife of Balwinder Singh at whose instance this case was registered against Smt. Renu at P.S. City Hoshiarpur. Smt. Renu is prosecuting Balwinder Singh and his father Nank Chand under Sections 406, 498-A, Indian Penal Code is case FIR No. 218 dated 15th September, 1997. During the investigation of case FIR No. 281 dated 15.9.97 (ibid), some articles were recovered lying in possession of Nank Chand and Balwinder Singh including scooter No. PB-07-D-6777.
(2.) According to the prosecution that scooter was in the name of Balwinder Singh. It was sold by Smt. Renu by forging the signatures of Balwinder Singh. According to the prosecution, sale of scooter by Smt. Renu was in breach of the conditions of the spurdagi bond. It is to be adjudicated by the Court trying case FIR No. 218 dated 15.9.97 whether that scooter was part of the dowry/stridhan of Smt. Renu or it was the property of Balwinder Singh. If it is found that that scooter was dowry/stridhan of Smt. Renu, then Balwinder Singh will be only benami owner of the scooter. Petitioner is a woman, Learned AAG, Punjab says that her specimen writing has been taken with a view to its comparison with the alleged signatures of Balwinder Singh on sale documents relating to the scooter.
(3.) In my opinion, Smt. Renu's custodial interrogation is not warranted. It is, therefore, ordered that in the event of arrest, the investigating officer will call upon Smt. Renu to furnish bail. She shall join the investigation and keep joining the investigation as per his direction.
