JUDGEMENT

(1.) The petitioners have filed this petition for quashing the orders dated October 24, 1983, (Annexure P-7) passed by Director of Public Instructions (Schools), Punjab, and dated June 30, 1988, (Annexure P-10) passed by the Presiding Officer, Schools Tribunal, Punjab, Chandigarh whereby respondent No. 3 Inder Singh, JBT Teacher has been ordered to be reinstated. Petitioner No. 1 Khalsa National Higher Secondary School is a privately managed recognised school and is run by Khalsa National Diwan, Ludhiana. Respondent No. 3 Inder Singh was appointed as JBT Teacher in Khalsa National Higher Secondary School on October 16, 1968. He was working against an aided post.

(2.) According to the petitioner, respondent No. 3 was absenting himself from duty habitually and had proved himself to be incorrigible. He absented from his duties with effect from March 11, 1979, and thereafter he did not report for duties even on sending various registered letter sent at his home address. As respondent No. 3 was absenting, so no grant could be claimed from the Government towards his salary.

(3.) Respondent No. 3 made a complaint to the District Officer of Grievances, Ludhiana, and the matter was resolved by him vide his Order dated June 14, 1979. According to the order, respondent No. 3 promised to behave well in the school and also to his duties on June 15, 1979. The petitioners further state that respondent No. 3 did not join his duties on June 15, 1979 and the higher authorities were informed on June 23, 1979, that respondent No. 3 did not turn up to his duties. Respondent No. 3, in fact, had abandoned his job with effect from March 12, 1979. An enquiry was held by Assistant Accounts Officer under the orders of the District Education Officer, Ludhiana, regarding the conduct of respondent No. 3 and Assistant Accounts Officer made a report stating that respondent No. 3 had abandoned his service right from March 12, 1979, vide his order dated February 10, 1982, Annexure P-6.
