JUDGEMENT

(1.) In this petition under Articles 226 and 227 of the Constitution of India, the petitioners have approached this Court for the quashing of orders dated 21st November, 1987 (Annexures P. 12 to P. 15), by which their services were terminated consequent upon the abolition of Construction Cell and the posts created therein by the Haryana State Cooperative Bank Ltd., Chandigarh.

The petitioners were appointed as Clerks by the respondent Bank, initially on probation, and after completion of the same, they were confirmed in service in accordance with the provisions of the Haryana State Cooperative Bank's Staff Service (Common Cadre) Rules, 1976. On 30th June, 1984, the Bank resolved to terminate the services of certain members of the technical staff of the Construction Cell but as the petitioners belonged to the clerical cadre of the Construction Cell, no such notice was issued to them and they continued to serve the Bank in the confirmed capacity of clerks.

(3.) On 2nd September, 1987, the Bank again resolved to abolish the posts created for the Technical Cell and decided to terminate the services of the employees, including the petitioners. The petitioners thereupon filed civil suits for obtaining injunction in the Court of Senior Subordinate Judge, Chandigarh, against the termination of their services. The learned trial Court granted the ex-parte injunction but the same was vacated later on and services of the petitioners were terminated by orders dated 21st November, 1987. The petitioners thereupon withdrew their suits and filed the present petition.
