JUDGEMENT

(1.) On June 17, 1975, Barkha Ram executed a registered Will bequeathing his entire property to Inder Devi, his sister's daughter. Did he, thereafter, on Dec. 18, 1976, that is, a day before his death revoke this Will? Herein lies the controversy in appeal.

(2.) The contest is for the property left behind by Barkha Ram. Inder Devi lays claims to it under the Will, while the plaintiff-Gant Ram stands to inherit It if the revocation of the Will is up-held.

(3.) Relying upon the revocation of the Will, Bant Ram sought a decree for declaration that he was the owner of the property in suit with the consequential relief of permanent injunction to restrain the defendant-Inder Devi from interrering with his possession.
