(1.) This revision petition arises out of an order declining the injunction to the plaintiff-petitioners directing the respondent Bank not to recruit Computer Programmer-cum-operators.

The short facts giving rise to this revision are that the Management of the Bank entered into an agreement with the employees A the Bank that a chance of promotion be given to them to compete for the said post after having the prescribed qualifications from the Institution recognised. The said agreement was circulated to the Branches of the Bank in Chandigarh circle. However, the petitioners contends that the said circular was not brought to their notice and so they could not acquire the required qualification and they have been deprived of their right to compete.
(3.) The counsel for the respondent states that the agreement was entered into with the Union of Bank employees who are their representatives. All agreements entered into by the representatives of the Union of the Bank are binding on them and they are presumed to know the agreement entered into. Under the agreement it is only the qualification from the recognised Institute which has been prescribed. The Bank has not undertaken to provide an opportunity to acquired the qualification. It was for the individual to acquired the qualifications agreed upon.
