JUDGEMENT

(1.) The short question for determination in this case is whether the tender made was short.

(2.) The ejectment of the tenant was sought on the ground of non-payment of rent from 1.8.1981, payable in advance, at the rate of Rs. 100/- per month. Admittedly, the tenant deposited Rs. 402.50 towards arrears of rent on 9.11.1981.

(3.) On 11.12.1981 i.e. on the first date of hearing he tendered Rs. 5/- as costs and Rs. 2.50 towards interest.
