(1.) Present petition under Section 438 of the Code of Criminal Procedure is for grant of anticipatory bail in case bearing FIR No.352 dated 01.10.2018 (Annexure P/2) under Section 13 of the Prevention of Corruption Act, 1988 and Sections 167, 420, 467, 468, 471 read with Section 120-B IPC registered at Police Station Civil Lines Jind, District Jind.
(2.) Learned senior counsel representing the petitioner contended that the petitioner has been falsely implicated whereas, he has no role in the present case. He was not posted in the relevant Division at the time of submission of bills. The bills do not bear his signatures. The petitioner is ready to join the investigation. So, the petitioner be released on pre-arrest bail in this case.

Learned State counsel while opposing the pre-arrest bail application of the petitioner contended that the petitioner is misusing the process of law as the FIR was registered on 1.10.2018 and the petitioner had been absconding through-out. The bills were actually verified by the petitioner without verifying the material at that stage and in connivance with other accused persons caused huge financial loss to the Nigam. The petitioner is required for the purpose of investigation. So, the pre-arrest bail application of the petitioner be dismissed.
