AMRITPAL KAUR Vs. STATE OF PUNJAB AND ORS.

JUDGEMENT

(1.) PRESENT petition has been filed under Section 482 Cr.P.C. seeking issuance of direction to register an FIR or to hand over the investigation of the case to the CBI or to some independent criminal agency.

(2.) GRIEVANCE of the petitioner is that her husband Harbhajan Singh was a driver on the harvest combine, owned by Balwinder Singh son of Ajaib Singh and Beant Singh son of Jit Singh. It is stated that on 28th February, 2008 deceased left with the harvest combine and while he was going to drop the paddy, the accident took place and deceased died.

(3.) REPLY has been filed by the State. It is stated that at the place, where the accident took place, the people who were present there, got the deceased admitted in the Hospital, where he died. Inquest proceedings were conducted and they were attested by the Ex -Sarpanch and father of the deceased. Compromise (Annexure R1/T) was also arrived at.
