JUDGEMENT

(1.) Learned counsel for the parties have been heard at length.

(2.) The petitioner's father, namely, Manjit Singh, is permanent resident of State of Punjab. He was born at village Shallapurbet, P.O. Talwandi Chudhrian, Tehsil Sultanpur Lodhi, District Kapurthala. The father of the petitioner also holds land at village Shallapurbet. It is further stated that grandfather of the petitioner, namely, Teja Singh also retired from Punjab Police. The petitioner's father born at Malerkotla in Punjab and had entire educational career in the State of Punjab right from schooling till acquiring the higher education of B.Com. from Guru Nanak Dev University, M.Com. and LL.B. from the Panjab University. The petitioner's father appeared in the All India University Service Examination and he was selected in Allied Services, namely, Armed Forces Head Quarter Civil Services. Presently, he is posted as Director, Personnel (Officers DPO-II) Air Force Head Quarter, New Delhi. It is the case of the petitioner that on account of the service of the petitioner's father outside Punjab, she pursued her studies at the place of posting of her father and passed ten plus two from the Appejay School, Sector-16, Noida, by securing 342 marks out of 400 (86.4%). Her percentage in Physics, Chemistry and Biology is 89% and in Physics, Chemistry, Biology and English the percentage is 85.5%. It is further the case of the petitioner that she wanted to pursue her career as a Doctor and preferred her own State i.e. Punjab for MBBS course. Respondent No. 2-University, issued Prospectus for admission to MBBS/BDS and other allied courses. The petitioner applied for her consideration for admission to said courses. Since the petitioner claims to be a bonafide resident of the State of Punjab and is a daughter of an officer who is serving in the Civil Wing of the Air Force, she applied in that capacity and sought consideration despite the fact that she had not passed ten plus two from the State of Punjab. The petitioner appeared in the Entrance Test on 14.06.2009 conducted by respondent No. 2-University and her ranking in the said test was at 270 with 584 marks. Since the petitioner was within the zone of consideration, she filled up admission form and participated in the counseling on 11.07.2009. The petitioner was, however, denied the admission on the ground that she did not pass her ten plus two examination from the Punjab State.

(3.) Having been denied the consideration for admission, the petitioner has filed this petition claiming her right of consideration/admission being a bonafide resident of the State of Punjab.
