JAGMINDER KAUR Vs. DIDAR SINGH

JUDGEMENT

(1.) THIS is a petition for transfer of case titled as 'Didar Singh versus Jagminder Kaur' from the court of Sh.Ranjit Kumar Jain, Addl. Civil Judge (Sr. Divn.), Patiala to the Court of competent jurisdiction at Jalandhar.

(2.) THE petitioner states that she is unable to travel to Patiala as she is staying at Nakodar which is at a considerable distance from Patiala and that she is unemployed and is living with her father and cannot take this travel repeatedly as it consumes time and money.

(3.) AFTER hearing learned counsel for the parties and keeping in view the observations of the Hon'ble Apex Court in 'Sumita Singh versus Kumar Sanjay and another' AIR 2002 SC 396, I am of the considered opinion that the present petition deserves to be allowed and the proceedings in case titled as 'Didar Singh versus Jagminder Kaur' pending at Patiala are transferred to a Court of competent jurisdiction at Jalandhar which is the nearest place to Nakodar.
